Illinois and Missouri are at-will employment states. This means that without an employment contract, employers can fire employees for any or no reason — as long it is not an illegal reason. Examples of illegal reasons are age discrimination and retaliatory discharge for filing a workers’ compensation claim.
Employment law cases are filled with land mines for the unwary. Not every attorney understands how to prosecute or defend these claims. For example, you cannot file a discrimination claim without first seeking an administrative remedy through the Equal Employment Opportunity Commission. The EEOC has 180 days to investigate your claim, after which they can give you a right-to-sue letter. If you don’t file a claim within 90 days of receiving a right-to-sue letter from the EEOC, you are forever barred from filing a claim.
